This Privacy Policy describes Farnsworth Group, Inc.’s (” FGI”) policies and processes on the collection, use, and disclosure of our website visitors and users’ (” Users”) personal information as well as privacy rights and how the law protects Users. This Privacy Policy governs the websites FGI and its related entities operate (“Website”).  The FGI Website is intended for commercial business purposes only and is not intended for use by consumers.  FGI does not sell or market good or services for use by consumers and consumers are discouraged from using the Website.

FGI may update this Privacy Policy or portions of this Privacy Policy from time to time. If changes are made to the Privacy Policy, FGI will indicate the date of revision at the top of the Privacy Policy which will be the date the revised policy will be effective.  Additionally, FGI will provide notice for a reasonable period of time on the Website, usually fourteen (14) days, indicating that the Privacy Policy has been updated. FGI encourages Users to review the Privacy Policy regularly.

1. Notice of Collection of Personal Information.

FGI endeavors to only collect information related to commercial uses and limit the collection of personal information.  Generally, as FGI’s services are for commercial purposes only, the collection of personal information is and should be limited in scope and use.  However, FGI may collect personal information from you in several ways in order to provide and market its services or for a related use such as employment with FGI. FGI may collect information from the following sources:

1. Personal Information Users Provided to FGI: FGI receives and stores any information a User provides in relation to:
2.  FGI services, such as an engagement with FGI to provide services,
3. communication with FGI via phone, chat, or email,
4. use of the Website,
5. submission of any information on the Website, including forms to sign up for email or newsletter correspondence,
6. job applications for roles with FGI.

The types of personal information that we may collect directly from Users may include contact, financial, and other identifying information and demographic information.

•  Personal Information FGI May Collect Passively: FGI may collect Internet or other electronic activity passively using tools like browser cookies, web beacons, and tracking pixels, SDKs, and other similar technologies.  FGI does not currently use all of these tools but such tools may be used in the future.

II. Personal Information which may be Collected

The information FGI may collect may include the following:

1. Contact Information and Other Identifiers: FGI may collect certain identifiers and contact information, such as name, postal  address, email address, company name, driver’s license number or similar identifiers
2. Customer Records: FGI may collect information regarding a User’s company or role within a company as well as related contact information including emails, addresses and telephone numbers.  FGI does not create or maintain customer records for consumers as FGI’s work is commercial in nature.  
3. Demographic Information: FGI may collect certain demographic information, such as gender or veteran’s status.
4. Commercial Information: FGI may collect details about services requested or purchased and/or projects or proposals for services.
5. Internet or Other Electronic Activity: FGI may collect information about a User’s browsing and search history, as well as a User’s interactions with FGI’s Website, applications, or other marketing materials or communications.
6. Geolocation Data: FGI may collect geolocation data, such as IP address.
7. Inferences: FGI may collect information about browsing tendencies and preferences.
8. Sensitive Personal Information: FGI may collect sensitive personal information, such as driver’s license number or passport number, for purposes including but not limited to maintaining records for an account or project where required by law, employment application process or conducting background checks where required for employment or projects.

III.Use of Information

FGI may use the categories of personal information collected that are identified above to provide, maintain, and improve its Website or services, including but not limited to:

1. To provide and maintain our Website or Services: To monitor the usage of the FGI Website, for client relations and service purposes, or to provide the services requested from FGI.
2. To manage Client Account: To manage a User’s registration as a user of any marketing or contact information that a User may have requested. The Personal Information a User provides may give a User access to different functionalities of the Website, now or in the future, and access to marketing or industry information from FGI.
3. For the performance of a contract: For the development, compliance and undertaking of a contract for the services FGI has been engaged to perform.
4. For contact purposes: To contact a User by email, telephone calls, SMS, or other equivalent forms of electronic communication. FGI may use a User’s Personal Information to contact a User with newsletters, marketing or promotional materials and other information that may be of interest to a User. Users may opt-out of receiving any, or all, of these communications from FGI by following the unsubscribe link or instructions provided in any email or text FGI may send or by contacting FGI using the contact information provided in this Privacy Policy.
5. To provide a User with updates: Including news and general information about other services and events which FGI may offer from time to time that are similar to those that a User has already engaged with FGI for previously unless a User has opted not to receive such information.
6. To manage a User’s requests: To attend and manage a User’s request to FGI.

IV. Disclosures of Personal Information

A.    Service Providers: FGI may share a User’s personal information with Service Providers to monitor and analyze the use of the Website, for email marketing, or to otherwise contact a User, etc.

B.      With Affiliates: FGI may share a User’s information with its affiliates, in which case FGI will require its affiliates to honor this Privacy Policy. Affiliates include subsidiaries, joint venture partners or other companies that FGI controls, may acquire or come to control or that are under common control with FGI.

C.     With Business Partners: We may share a User’s information with FGI business partners to offer a User certain services.

D.    Business Transactions:  If FGI is involved in a merger, acquisition or asset sale, personal information may be transferred. FGI will provide notice before any personal information is transferred and becomes subject to a different Privacy Policy.

E.     Law enforcement:  Under certain circumstances, FGI may disclose a User’s personal information if required to do so by law or in response to valid requests by public authorities, law enforcement or civil process pursuant to a legal and valid court order, subpoena or as otherwise required by valid and applicable law.

F.     Fraud Prevention: FGI may disclose personal information when FGI believes disclosure is necessary to investigate, prevent, or respond to suspected illegal or fraudulent activity or to protect the safety, rights, or property of FGI, Users, or others.

V. Retaining Personal Information

FGI will retain personal information only for as long as is necessary for the purposes set out in this Privacy Policy. FGI will retain and use personal information to the extent necessary to comply with its legal obligations (for example, if FGI is required to retain data to comply with applicable laws), resolve disputes, and enforce its legal agreements and policies.

FGI will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of the Website, services, or legal obligations requiring a longer retention period.

•  Cookie Usage

FGI uses cookies and similar tools to improve the performance and security of the Website and to enhance User experience.  Before entering the Website, Users will be asked to opt in or out of cookies and may update choices regarding privacy, including the use of cookies and types of cookies used at any time by visiting the link on the Website.

Cookies are small text files which a website may put on a computer or mobile device when a user visits a website. Cookies assist the website in recognizing a device or browser the next time the user visits the website, help with a user’s preferences and for website navigation.  Other technologies may also be used for similar purposes and are included in the term cookies for purposes of this policy. Cookies include temporary or session cookies that expire once a browser is closed and persistent cookies which remain on a device until the cookie is deleted.

FGI uses or may use several different categories of cookies:

1. Essential cookies: These cookies are necessary for the proper operation of the Website and perform functions such as facilitating navigation.
2. Functionality cookies:  These cookies are used to enhance the Website experience for a user and perform functions such as remembering a user’s preferences.
3. Performance/analytics cookies:  These cookies are used determine how Users use the Website and to measure performance of the Website leading to fixes for issues that exist or updating content based on interest. 
4. Targeting/behavioral cookies: These cookies are used to direct you to content that might be of interest to a User or may be used by a third party when we include thirty-party content on the Website.

FGI uses or allows some third parties to serve cookies on the Website for a variety of purposes including identifying fraudulent traffic, providing content or assisting with market research. For example, we use Google Analytics to help evaluate website traffic on the Website. Users are encouraged to review the Cookie Policy and the Privacy Policy periodically.

To the extent that collection technologies are considered a “sale/share” or where FGI undertakes targeted advertising under state privacy laws, a User may exercise a right to opt-out (see the “State Privacy Rights” section below for more information) by doing either of the following:

1. Click on the link in the footer of our website and adjust your preferences. Please note that a request to opt-out will be linked to the browser identifier only for the browser used to access the website. If a different computer or browser accesses the Website, the preferences for those devices or browsers will need to be set; or
   1. Broadcast an opt-out preference signal, such as by enabling Global Privacy Control (GPC) where supported by the browsers. To download and use a browser supporting GPC signals, visit https://globalprivacycontrol.org/orgs. This must be implemented for each browser or browser extension used.

Some web browsers incorporate a ” Do Not Track” feature that signals to websites visited that the User does not want to have online activity tracked. Various state privacy laws require that website operators disclose how they respond to a Do Not Track signal and whether other third parties may collect personally identifiable information about an individual’ s online activities from their site or service.  FGI currently does not respond to ” Do Not Track” signals. FGI may make changes to our policy regarding Do Not Track signals in the future and Users should review the Privacy Policy regularly for updates.

VII. Security of Personal Information

The security of personal information is important to FGI but no method of transmission over the Internet, or method of electronic storage is completely secure. While FGI strives to use commercially acceptable means to protect personal information, FGI cannot and does not guarantee the absolute security of any personal information transmitted to FGI over the Internet or otherwise transmitted electronically to FGI.

Laws governing privacy in the United States provide certain protections for consumers regarding their personal information and privacy.  While the FGI Website is not intended for nor is to be used by consumers, FGI provides the following information.  The section on exercising your rights is set forth in this Privacy Policy and provides information on how to submit and proceed with a request.  

1. Users have the right to request a disclosure of categories of personal information collected, used, disclosed, or sold as well as a copy of personal information in a format that is portable, usable, and allows you to transmit the personal information to a person without impediment or hindrance provided it is technically feasible to provide a copy.
   1. Users may request that personal information be deleted, subject to certain legal exceptions or requirements to retain the information pursuant to law.  
   1. Users may ask to for personal information to be corrected if it is inaccurate and has been retained.  
   1. Users may opt out of the sale or sharing of their personal information with any third party or opt out of any targeting advertising. 
   1. Users may request that sensitive personal information be used for a limited purpose, for example, providing services requested by the User.
   1. Users may opt out of the processing of personal information for profiling that results in decisions that may produce legal or equal significant effects concerning a consumer.  FGI does not engage in this practice.
   1. Oregon residents also have the right, at our option, to receive a list of third parties, other than natural persons, to which personal information, either the users or any collected personal information, was disclosed.

Some privacy laws may provide additional protection for sensitive personal information.  Please refer to the section on sensitive personal information in this policy for more information on the sensitive persona information that may be collected.

If a request to exercise a privacy right is denied, you will be informed of the reason for the denial along with instructions on how to appeal the decision denying the request. 

Users will not be discriminated against for exercising any of their legal privacy rights and unless permitted or required by law, a User so exercising their rights will not be denied services, be charged fees for services or receive a quality of service that is different than those provided to Users who did not exercise their privacy rights.

1. EEA PRIVACY POLICY PROVISIONS: ADDITIONAL INFORMATION FOR WEBSITE VISITORS IN THE EEA

This Section only applies to personal information for Users who visit the FGI Website from the EEA.

1. Purpose and basis for processing

FGI’s processing of personal information depends on the particular circumstances, including how the Website is being used, which communication method is selected, or the nature of a given communication between FGI and the User. In addition to the details provided in the Information Collection and Processing section of the main text of our Privacy Policy, FGI provides the following information:

The processing of personal information by FGI is dependent on the circumstances of each individual and their use of the website.  This may include how a communication occurs and the nature of such communication. 

• Inquiries and communications. FGI will process personal information in order to respond to inquiries that a User makes and with the User’s consent.  Personal Information may also be processed in order to conduct business such as preparing for the performance of services or to enter into a contract. 
• Communication subscriptions. FGI may send emails or written hard copy communications to a User which has been requested by and consented to by the User.  Users always have the option to unsubscribe from any emails by following the instructions in the emails or by contacting us at the contact information provided in this Privacy Policy. 
• Business contacts. FGI may obtain your contact information either through its online presence or through offline communications.  FGI may send emails or call you regarding information about FGI’s business and services which may include news or marketing information.  This communication will occur based on your consent and a legitimate interest in communicating with a User for business purposes and in compliance with applicable law. 
• Audio and visual information. FGI may record online meetings with consent of the participants.  Additionally, FGI may collect and store video through security cameras for in person visits at one of the FGI offices in order to maintain safety and security and deterring criminal activity at the office location.  This information may be used to ensure the safety of our visitors and employees as well as assist law enforcement if necessary. 
• Employment submissions. Job application information includes name, email and physical address, phone number, educational and job history, and other information submitted for a position with FGI. Job application information may be collected and processed by FGI directly through email or may be collected and processed on FGI’s behalf by one of FGI’s processors. With the applicant’s request and consent, personal information submitted by an applicant is used to evaluate the applicant for the role, review qualifications and to contact the applicant about the role, an offer of employment, other job opportunities with FGI or for legal or compliance requirements.
• Social media. FGI processes personal information it receives on its social media pages to respond to inquiries, with the submitter’s request and consent. FGI may also process personal information based upon a legitimate interests to improve its social media presence and published content, to interact with social media users about legitimate business interests, and to receive and consider comments about the business and services.
• Cookies and log files. FGI processes personal information collected through cookies or other technologies which are essential for the functioning of the website and processes log data related to a User’s use of the website to improve performance and prevent fraud or illegal use of the website.  FGI does so for its legitimate interest in providing a safe and user friendly website that is high quality and high functioning.  Any other personal information that we process through the use of other cookies or technology is done so with the consent of the User.  Please see additional information in our cookie policy section in this Privacy Policy. 

2. Information sharing and transfers

The following is in addition to the information sharing provisions set forth above in this Privacy Policy:

• FGI may share personal information with affiliates as necessary in preparing for or performing an employment contract, complying with legal obligations, or for the legitimate interest in facilitating internal functions such as accounting, tax or human resources, among other legitimate purposes.   Currently, all FGI information is shared within the United States of America.  However, to the extent that any personal information may be transferred outside the EEA in the future to a country for which there is no adequacy decision by the European Commission, such transfers will be made pursuant to an intercompany agreement in order to comply with applicable EU Standard Contract Clauses.
• FGI may share personal information with vendors and service providers based on our legitimate interests to provide quality goods and services and to maintain, improve, and grow our business and our workforce. To the extent that any personal information is transferred outside the EEA to a country for which there is no adequacy decision by the European Commission, FGI will ensure an adequate level of data protection through appropriate safeguards, for example, EU Standard Contract Clauses or Binding Corporate Rule certification. • FGI may share personal information with legal authorities or law enforcement where required by law or valid legal process.  FGI does so based upon its requirements to act in accordance with the law and for its legitimate interest in complying with the law.  To the extent FGI discloses any persona information for purposes of an acquisition, disposition, reorganization, financing or any insolvency or bankruptcy process, such is done so with the legitimate interest in maintaining the financial health and potential of FGI and its operations.  Disclosures made for any of these purposes will be disclosed to a User to the extent allowed by law and in accordance with applicable legal procedure. 

3. How long we process personal information

FGI will delete or anonymize personal information when it is no longer necessary to process the data for the purpose(s) for which it was collected. If personal information must be retained, appropriate security controls to prevent the unauthorized accessing, use, or processing of the data will be utilized and measures to prevent accidental loss, destruction, or damage to the data will be undertaken. FGI conducts periodic audits or reviews to ensure that personal information is securely deleted consistent with its policies and applicable law.

However, FGI may maintain personal information for a longer period of time for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes, including if retention of the personal information is necessary to fulfil legal obligations (including under legislation or regulations, to defend or assert legal claims, for fraud prevention, or for litigation hold purposes). Further, personal information may be deleted if a data subject appropriately invokes the right to be forgotten as to such personal information.

4. Rights as a data subject

Data subjects in the EEA have certain rights in relation to the processing of your personal information:

• Right to information. FGI will provide information about how it processes personal information and is utilizing this Privacy Policy to comply with this obligation.
• Right to access. Data subjects may request confirmation of the processing of personal information regarding the data subject.  If FGI is processing personal information regarding the data subject, FGI will provide access to the information as well as more details on the information and processing of such information.
• Right to data portability. Where personal information is processed by automated means and it is being legally processed based upon consent or a contract performance, the data subject may be entitled to request a subset of the data subject’s personal information in a structured, commonly used and machine -readable format and in some circumstance, a data subject may request that the personal information be sent directly to another data collector. 
• Right to rectification. FGI endeavors to ensure all personal information is accurate.  If a data subject finds that the data subject’s personal information is not accurate or incomplete, the data subject may request a correction or for the personal information to be completed.
• Right to erasure. Subject to compliance with legal obligations or the establishment or defense of a legal claim, a data subject may request the erasure of personal information if a) processing was based on consent and consent is withdrawn, b) no overriding legitimate interest exists at the time of the request and the data subject objects to the processing, c) the personal information is not lawfully possessed or d) erasure must occur to comply with a legal obligation. 
• Right to restriction. A data subject may request that data processing be temporarily restricted in certain situations; for example, recertification requests where a data subject believes personal information is inaccurate or where a data subject does not believe there is a legitimate legal basis for retention of the personal information.
• Right to objection. In certain circumstances (e.g., where the legal basis for processing is a legitimate interest or if we are performing direct marketing), a data subject may object to continued processing for those purposes. If an objection is made a re-evaluation of the legitimate business interest and the data protection interests will occur.  Continued processing will occur if, a) a compelling legitimate basis for continued processing overrides the data subjects interests, rights and freedoms, or b) processing is necessary to establish, enforce or defend legal claims.
• Right to lodge a complaint. FGI welcomes the opportunity to resolve any data protection concerns directly with the data subject. However, if there is a belief that data protection obligations set forth in the General Data Protection Regulation were not complied with, a data subject has the right to submit a complaint with a supervisory authority in the EEA country where the data subject resides, works, or where a suspect an infringement may have occurred.

X. Exercising Privacy Rights

Users may exercise privacy rights by submitting a request through the email below or through the toll free number within the Contact Us section below.

Before processing a request, the User will be asked a series of questions in order to attempt to verify identity. If a User uses an authorized agent to make a request on the User’s behalf, FGI may ask the agent to verify its identity and confirm with the User that the User provided the authorized agent with permission to submit the request.

FGI endeavors to respond to requests within 30 days of its receipt, but FGI is allowed by law to take up to 45 days to respond. If FGI requires more time (up to 90 days total), FGI will inform the User, or User’s agent, of the reason and extension period in writing. FGI cannot respond to a request or provide the User with personal information if FGI cannot verify identity or authority to make the request and confirm the personal information relates to the User. Making a verifiable consumer request does not require the User to create any account with FGI.
